These four companies, and the time period of their known operations at the site, <br /> are as follows: ARCO? (1928-193.3),Union(1945-1957)1,Douglas Oil (1957--1971), and <br /> Texaco(1971-1977). The gas station was demolished and the underground storage tanks and <br /> related equipment were removed in 1979. The current restaurant}wilding was built in 1980: <br /> It appears that discharges of gasoline into the soil beneath the site occurred <br /> during operations of the gas station. The time period during which those discharges occurred <br /> is not known... The first generation underground storage tank system at the site was <br /> apparently located in the northern:portion of the property, and was operated by ARCO}and <br /> Union "fie second generation tank system was located in the southern portion,of the <br /> property;and was operated by Douglas and Texaco. Subsurface soil contamination has been. <br /> identified in both areas of the property:. <br /> The Federal Deposit Insurance Corporation("FDIC") acquired the property as <br /> the:rece ver for City Thrift and.Loan Association. In October, 1993 the FDIC;sold the <br /> property to Ms.Dolores Staudenraus. Prior to this sale, the FDIC disclosed to Ms. <br /> Staudenraus that the property was contaminated due to discharges`front the gasalne sta"tion: <br /> As part o f he sale agreement,the FM.agreed that it would continue to perform soil <br /> remediation work which was already underway, and to do so until the appropriate regulatory <br /> agency approved the discontinuation of such efforts. A copy of the Purchase and Sade. <br /> Agreement is attached-as E0ibit.2;the Agreement addresses the.: ssue of contamination in <br /> Pert Y,paragraph 19 and elsewhere throughout the document. <br /> he San loa4uin County Public Health Services department,En�[ronrnental. <br /> Health Division C PHS-EIIU'),is the local agency with responsibility fbr overseeing site <br /> investigation and remediation efforts. <br /> IL PRIME PAM`LITIGATM <br /> in July; 1992,the FDIC's predecessor in interest(City Thrift;and Loan)filed <br /> suit against Texaco,Douglas;Union and:ARCO) in an attempt to recover from them.,the costs <br /> of investigating:and remediating the contamination at the property. The case was <br /> subsequently transferred to.United States;District Court anel Bokides Petroleum; Inc., <br /> 1933 <br /> 1 Itis not clear whether it was ARCO}or Union that+operated the site between `and 1945. <br />
