Correspondence from Dave Deaner (State Water Resources } <br /> Control Board ) to Laurie Cotulla of San Joaquin PHS, dated <br /> 12-16-911 states. "Even if previously exempt farm tanks <br /> have been inappropriately required to comply with UST permit <br /> and closure requirements, this does not improve the SB2004 <br /> eligibility status of such tanks. " <br /> Who is interpreting these laws? Why was it "inappropriately <br /> required"? Is the State Water Resources Control Board given <br /> the privilege of interpreting these documents? There <br /> appears to be too many changes and new implementations <br /> without thorough understanding of all implications. AB1699 <br /> seems to be the final blow. <br /> The amount I ' m hoping to be reimbursed from the UST Cleanup <br /> Fund is almost $50,000.00. This may not seem like a large <br /> amount of money to you ; but at 76 years of age, it means the <br /> differences between "getting by" on a fixed income or <br /> declaring bankruptcy and going on welfare. This is a very <br /> grave matter of concern to me. After almost 60 years of <br /> living , working , and paying taxes in CA. , is this my thank <br /> you? It appears that I ' m being punished with ineligibility <br /> for following laws in effect at the time of 7-17-91 . <br /> If the true intent of these laws is to eliminate <br /> contamination in this state, does it make sense to remove <br /> permitting requirements with no "teeth" to demand ' <br /> appropriate cleanup? No one would voluntarily go through <br /> what I ' ve experienced . <br /> I ' m asking for your assistance in this matter since it seems <br /> to require legislative action in order for me to participate <br /> in the Cleanup Fund . <br /> I look forward to your response and anticipated assistance. <br /> Thank you . <br /> Yours truly , <br /> M.
