Jahant Rd <br /> Acampo, CA 95220 <br /> Re: SB 2004 Cleanup Fund Eligibility <br /> Dear Mr. and Mrs. Grenz: <br /> The State Water Resources Control Board (SWRCB) has responded to <br /> our request for clarification of the eligibility for the SB 2004 <br /> Clean- up Fund of previously exempt farm tank owners. Enclosed is <br /> a copy of the SWRCB letter. <br /> As noted in the letter, recent legislation (AB 1699) placed <br /> conditions on SB 2004 eligibility which are retroactive to January <br /> 1, 1985. Specifically the letter states that whether or not farm <br /> tank owners complied with closure and operating permit requirements <br /> when they discontinued use of a tank for agricultural purposes, <br /> they are not eligible for the Fund if the tank was located on <br /> agricultural property on or after January 1, 1985.
