31! . 5 Licensee shall maintain and keep in good repair said 1 groundwater monitoring wells installed pursuant to this License Agreement. i 3 . 6 Licensee agrees to indemnify , defend , and save licensor harmless from all liability , damage expense, cause of action, suits, claims, orjudgments ' resulting from injuries to person or damage to property .on the licensed area or on adjoining streets and sidewalks which arise out of the act, failure to act, or negligence of licensee, its agents, employees, i vitees or quests. 3 . 7 Licensee agrees to indemnify , defend , and save licensor i harmless from all liability , damage, expense, cause of action, suits , claims , or judgments result ' ng from a discovery of the presence of contaminated groundwater at the Property. Licensee further agrees that if any significant contaminants are discovered' in such groundwater pursuant to the investigation of the results of such groundwater monitoring , license shall undertake the cleanup of such contamination at its sole c st and expense to the satin= faction of the California Regional Water Quality Control Board and shall hold licensor harmless and indemnify licensor for all such costs and expenses involved in such cleanup process. 3 . 8 Licensee agrees that nothing herein shall be construed as i giving licensee any interest in any award or payment made to licensor in connection with any exercise of eminent domain or transfer in lieu thereof affecting li ensor' s property. 3 . 9 This license shall not constitute a deed or a grant of easement and shall not be deemed irrevocable or like an easement by virtue of the work performed under or by reason of this license. 3 . 10 This license may be terminated by either party upon thirty ( 30 ) days '�)rior written notice.
