PREVIOUSLY APPROVED FINDINGS <br /> PA-1600266 <br /> PHRABUDDHIVONGSAMUNEE BUDDHIST TEMPLE/DAVID MIRAFLOR <br /> 1. The proposed use is consistent with the General Plan, any applicable Master Plan, Specific Plan, and <br /> Special Purpose Plan and any other applicable plan adopted by the County. <br /> • This finding can be made because the Religious Assembly-Neighborhood use type is <br /> consistent with the General Plan's General Agriculture(A/G)designation and in turn may be <br /> conditionally permitted with a Use Permit application in the General Agriculture, 40 acre <br /> minimum (AG-40) zone. The proposed expansion of an existing neighborhood religious <br /> assembly is consistent with the goals, policies, standards, and maps of the General Plan, <br /> and there are no Master Plans or Special Purpose Plan applicable to this site. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the necessary facilities and improvements are existing <br /> or proposed. The Environmental Health Department is requiring a soil suitability/nitrate <br /> loading study that incorporates the proposed expansion to determine the area suitable for <br /> septic tank usage. The construction of an individual sewage disposal system under permit <br /> and inspection by the Environmental Health Department is required at the time of <br /> development based on the San Joaquin County Sewage Standards and proposed <br /> population served. Also as a Condition of Approval, the Department of Public Works is <br /> requiring the developer to provide drainage facilities that meet the requirements of San <br /> Joaquin County Development Standards for any additional runoff attributed to this project <br /> development. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 4.6-acre parcel is of adequate size and shape to <br /> accommodate the proposed expansion to the existing neighborhood religious assembly <br /> facility and all necessary improvements. The site plan shows that there is sufficient area <br /> for parking and circulation, in compliance with Standards of the Development Title. The <br /> access driveway meets the twenty-five(25)foot minimum requirement for two-way access. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be <br /> injurious to the property or improvements of adjacent properties <br /> • This finding can be made because the Initial Study prepared for the project found no <br /> potentially significant environmental impacts. Outdoor events shall comply with the noise <br /> performance standards for stationary noise to assure any impacts are less than significant. <br /> 5. The use is compatible with adjoining land use. <br /> • This finding can be made because the proposed use will not interfere with nor alter the <br /> current land uses on adjacent properties. The surrounding parcels are agricultural with <br /> scattered residences. The proposed use may be conditionally permitted in the AG-40 zone <br /> with an approved Use Permit application. <br /> PA-1600266— Previously Approved Findings 1 <br />
