Any collected data requested by Caltrans shall be furnished to Caltrans without charge. <br /> 6. Vehicles necessary for work may be parked in State Highway right of way off paved shoulders. Auxiliary <br /> support and employee vehicles shall remain outside the 'ght of way. <br /> 7. Permittee shall provide for the safe passage of pedestrians. <br /> B. THIS PERMIT AUTHORIZES WORK ON CONVENl IONAL HIGHWAYS ONLY. <br /> All work shall be performed in accordance with the current Departmelxt of Transportation Standard <br /> Specifications and the Department of Transportation Encroachment Permit Utility provision dated August <br /> 1998. <br /> All work shall be conducted in such a manner that the etc avation, excavated earth, materials ind equipment <br /> will not cause any inconvenience to the highway traffic or o traffic entering the highway frorr any public or <br /> private approach. <br /> No earth or construction materials are to be dragged or s ed across the highway pavement. No excavated <br /> earth shall be placed or allowed to remain at a location whe a it can be tracker.onto the highwa;(traveled way <br /> or any public or private approach by the Permittee's constr iction equipment, or by traffic enter ing or leaving <br /> the highway traveled way. Any excavated earth or mud so tracked onto the taighway pavemeait or public or <br /> private approach shall be immediately removed by the Pe ttee. <br /> The State of California, Department of Transportation makes no assurance or expressed wa)xanty that the <br /> plans are complete or that the planned construction fifield conditions. Should additional work or <br /> modifications of the work be required in order to meet established Department Standards or in oa-der to fit field <br /> conditions, the work shall be performed by Permittee as dire-.ted by the State's Inspector. <br /> The Permittee shall indemnify and save harmless the State of California and all officers and employees thereof <br /> connected with the work or activity authorized by this perm t, including but not limited to the D;rector and the <br /> Engineer, from all claims, suits or actions of every name, ind, and description, brought forth, or on account <br /> of, injuries to or death of any person including but not lim' ed to worlanen or participants and the public, or <br /> damage to property resulting from the perfvr mance of a activity authorized by the pern iit, except as <br /> otherwise provided by statute. The duty of the Permittee to indemnify and save harmless includes the duties <br /> to defend as set forth in Section 2778 of the Civil Code. <br /> It is the intent of the parties that the Permittee will indemnify and hold harmless the State, it y officers and <br /> employees from any and all claims, suits of actions as set forth above regardless of the existenc: or degree of <br /> fault or negligence on the part of the State,the Permittee, the employee or volwateer of any of th<se, other than <br />
