Paint used for markings shall be water-soluble and other markers shall be removed upon completion of work. 5. Any collected data requested by Caltrans shall be furnished to Caltrans without charge. 6. Vehicles necessary for work may be parked in State Highway right of way off paved shoulders. Auxiliary support and employee vehicles shall remain outside the 'ght of way. 7. Permittee shall provide for the safe passage of pedestrians. B. THIS PERMIT AUTHORIZES WORK ON CONVENl IONAL HIGHWAYS ONLY. All work shall be performed in accordance with the current Departmelxt of Transportation Standard Specifications and the Department of Transportation Encroachment Permit Utility provision dated August 1998. All work shall be conducted in such a manner that the etc avation, excavated earth, materials ind equipment will not cause any inconvenience to the highway traffic or o traffic entering the highway frorr any public or private approach. No earth or construction materials are to be dragged or s ed across the highway pavement. No excavated earth shall be placed or allowed to remain at a location whe a it can be tracker.onto the highwa;(traveled way or any public or private approach by the Permittee's constr iction equipment, or by traffic enter ing or leaving the highway traveled way. Any excavated earth or mud so tracked onto the taighway pavemeait or public or private approach shall be immediately removed by the Pe ttee. The State of California, Department of Transportation makes no assurance or expressed wa)xanty that the plans are complete or that the planned construction fifield conditions. Should additional work or modifications of the work be required in order to meet established Department Standards or in oa-der to fit field conditions, the work shall be performed by Permittee as dire-.ted by the State's Inspector. The Permittee shall indemnify and save harmless the State of California and all officers and employees thereof connected with the work or activity authorized by this perm t, including but not limited to the D;rector and the Engineer, from all claims, suits or actions of every name, ind, and description, brought forth, or on account of, injuries to or death of any person including but not lim' ed to worlanen or participants and the public, or damage to property resulting from the perfvr mance of a activity authorized by the pern iit, except as otherwise provided by statute. The duty of the Permittee to indemnify and save harmless includes the duties to defend as set forth in Section 2778 of the Civil Code.
