Item No . 2 _
PC : 4-20-89
MS-89-44
Page 2
STAFF ANALYSIS
On February 27 , 1989, the Planning Division denied Minor
Subdivision Application No. MS-89-44 due to the inability to make
Findings No. 1 , 2 , 3 , 4 , and 6 listed below.
FINDINGS
1 . The proposed map is not consistent with applicable General
and Specific Plans , as specified in Section 65451 of the
Code, because access for the proposed subdivision is not
"functionally designed" and does not "conform with adequate
safety standards" as required by the Land Use/Circulation
Element of the General Plan. There are no applicable
Specific Plans.
2 . The design or improvement of the proposed subdivision is not
consistent with applicable General and Specific Plans because
access for the proposed subdivision is not "functionally
designed" and does not "conform with adequate safety stan-
dards" as required by the Land Use/Circulation Element of the
General Plan. There are no applicable Specific Plans .
3 . The site is not physically suitable for this type of develop-
ment because there is no reasonable way to access the parcel .
The proposed access relies on easements over two parcels and
is located very close to existing structures . The turnaround
at the end of the driveway reduces the usable lot area to
well below the intended lot size for the zone . Access would
be confusing for emergency vehicles.
4 . The site is not physically suited for the proposed density of
development because the site cannot accommodate access to the
proposed residence .
5 . The design of the subdivision or the proposed improvements
are not likely to cause substantial environmental damage or
substantially and unavoidably injure fish or wildlife or
their habitat because an Initial Study prepared for the pro-
ject did not identify any rare or endangered species on the
site, nor did it identify any substantial , adverse environ-
mental effects.
6. The design of the subdivision or the type of improvements is
likely to cause serious public health problems because access
for emergency vehicles is poor.
7 . The design of the subdivision or the type of improvements
will not conflict with easements acquired by the public at
