IN[NUMBER 0 i 7763; FOR SITE <br /> ADDRESS: 24100 LAMMERS RD S,TRACY <br /> After reviewing your claim application to the Cleanup F , we find that the following additional <br /> information is needed to determine your eligibility for placement on the Priority List: <br /> • Claimant name as listed on page one (1) of your claim application (Estate of Ernest Pombo) should <br /> match the name as listed on your federal tax returns (Estate of Ernest J. Pombo Sr.). Please make <br /> revision on enclosed copy of page one. <br /> Priority Class "B" small business is for those businesses t t are independently owned and operated,not <br /> dominant in its field of operation and employs 100 or lessemployees, including all affiliates, and <br /> averages annual gross receipts of$10 million dollars or les over the previous three years. If a business is <br /> a manufacturer,there is no revenue test. However, the ma ufacturer must also employ 100 or less <br /> employees including affiliates. <br /> If you believe that you qualify,you may request the Fund review your claim to determine eligibility for <br /> Priority Class "B". In order to determine eligibility, the fo lowing documents must be submitted and <br /> reviewed: <br /> • Complete the Enclosed form"Request for Assignment of Claim to Priority Class B". <br /> AND <br /> • Submit documentation supporting the number{of empl gees far the claimant, claimants business and <br /> any affiliates(i.e. Department of Employment Development(DE6)payroll reports for the last four <br /> quarters, or submit a signed certification that claimant does not employ more than 100 employees). <br /> It is noted that Above Ground Tanks (AGT) also exist(ed) at the above site.
