Inc.,a Pennsylvania corporation by and through its contract <br /> operator, Chevron Environmental Management Company, a California corporation, <br /> (hereinafter"Chevron")and Dhalvinder Kaur Singh(hereinafter"Owner"). <br /> WHEREAS,Owner holds record title to a certain real properties at 14200 and <br /> 14222 West Byron Road,(parcel numbers 209-270-13 and 209-270-14)in the City of <br /> Tracy, and said parcel is situated in the County of San Joaquin, State of California, <br /> hereinafter(the"Properties");and <br /> WHEREAS,Standard Oil Company of California,the predecessor to Chevron <br /> U.S.A. Inc.,operated a crude oil pipeline on a right-of-way adjacent to the Property; and <br /> WHEREAS,Chevron conducted several investigations to determine the extent of <br /> petroleum hydrocarbon-affected soil and groundwater on real property located adjacent to <br /> the Property; and <br /> WHEREAS, Chevron desires to continue its investigation activities which will <br /> include activities on the Property; and <br /> WHEREAS,certain governmental agencies may request Chevron to perform <br /> additional evaluation of the residual petroleum hydrocarbon-affected soil and <br /> groundwater at and in the vicinity of the Property; the additional evaluation may include <br /> the installation of groundwater monitoring wells or piezometers. <br /> NOW THEREFORE,in consideration of the material promises contained <br /> herein,the parties agree as follows: <br /> 1. As part of its assessment of environmental conditions present on the Property, <br /> Chevron desires access to the Property to perform assessment activities to <br /> define the extent, if any,of petroleum hydrocarbon-affected soil and <br /> groundwater present on the Property. Owner grants Chevron reasonable <br /> access to the Property provided that reasonable advance notice is provided to <br /> Ovrner by Chevron of its desire for access. Owner shall thereafter provide <br /> written verification and consent to Chevron that it may enter upon the <br /> Property for the purpose of performing an environmental site assessment of <br /> surface and sub-surface conditions. Said assessment may include soil and <br /> groundwater delineation and sampling activities and the installation of <br /> monitor wells if such installation is deemed by Chevron to be prudent <br /> practice. In the event that Chevron desires to install monitor wells,..it shall <br /> first secure Owner's approval of the location of said wells,which approval <br /> shall not be unreasonably withheld. <br /> Site Access Agreement:SingWatellus Properties <br /> 14!10/05 <br />
