Box 536 <br /> Rio Vista, CA 94571-0536 <br /> LATE REVISIONS TO TENTATIVE REVISED WASTE DISCHARGE REQUIREMENTS, <br /> STOCKTON DEEP WATER SHIP CHANNEL MAINTENANCE DREDGING ACTIVITES FROM <br /> CHANNEL MILE 4.4 TO MILE 41.0, CONTRA COSTA, SACRAMENTO AND SAN JOAQUIN <br /> COUNTIES <br /> Staff has reviewed comments received regarding the tentative revised Waste Discharge Requirements <br /> (WDRs) Order for the Stockton Deep Water Ship Channel Maintenance Dredging Activities,which is <br /> being revised to include the expansion of the two dredge material disposal (DMD) sites on Sherman <br /> Island. Staff has considered the comments and has made several changes to the tentative AMR& In <br /> addition, staff incorporated the mitigation measure necessary for the protection of aquatic wildlife into <br /> the WDRs Order that was specified in the Final Environmental Assessment (EA), dated <br /> 25 February 2004, for the Sherman Island DMD sites. The EA contained a finding of"No Significant <br /> Impact" for the proposed DMD expansion project with the listed mitigation measure. <br /> One commenter expressed concerns that the mercury effluent limitation specified in the Order is not <br /> sufficient to prevent the bioaccumulation of mercury in aquatic species. The commenter recommended <br /> that a lower limit for mercury be developed for the WDRs in order to ensure the DMD sites do not <br /> contribute methyl mercury to the Delta. The mercury limitation is derived from the California Toxic <br /> Rule, which is currently the most restrictive limit for mercury. Furthermore, it is not known if the DMD <br /> sites would actually produce methyl mercury in either the decant discharge or stormwater runoff from <br /> the site. <br /> Sherman Island is a low delta island. Low islands have a land surface elevation that is generally less than <br /> the surrounding water elevation, and soils may become saturated for prolonged periods of time, <br /> particularly during the wet season. The saturated soils may create a marsh like condition that is <br /> favorable to the production of methyl mercury.
