Box 2089 <br /> Sacramento, California 95814-2922 Stockton, California 95201 <br /> CONDITIONAL NOTICE OF APPLICABILITY OF GENERAL ORDER, WASTE <br /> DISCHARGE REQUIREMENTS FOR UNITED STATES ARMY CORPS OF ENGINEERS <br /> AND THE PORT OF STOCKTON, SAN JOAQUIN, SACRAMENTO, AND CONTRA COSTA <br /> COUNTIES (ORDER NO. 96-220) <br /> The U.S. Army Corps of Engineers (COE) and the Port of Stockton (Port) on 26 July 1999 and <br /> 27 July 1999 submitted a Notice of Intent (NOI) for the use of General Order 96-220 for a proposed <br /> maintenance dredging project along the Stockton Deep Water Channel at the channel reaches adjacent to <br /> the Sherman Island, Bradford Island, Robert Islands, and the Old Dock. Because the NOI does not <br /> include the Disposal Plan, Water Quality and Testing Plan, and a Toxicity and Contaminant Reduction <br /> Plan, we are providing a Conditional Notice of Applicability (NOA) for the use of General Order 96- <br /> 220. When we have received and reviewed the three plans, we will be able to lift the conditions to the <br /> NOA. No dredging is to be performed until a final NOA has been issued. <br /> The COE proposes to place dredged material in three disposal sites near Stockton (S-4, Roberts Island I <br /> &11), one site on Bradford Island, and three lower river sites (Scour Pond, McCormick Pit, and Augusto <br /> Pit). Three of the dredged material disposal (DMD) sites are specifically identified in the General Order <br /> (Roberts Island I and H, and S-4 site). The other proposed sediment disposal sites are not named in the <br /> General Order(Scour Pond, McCormick Pit, Augusto Pit, and Bradford Island). Because these DMD <br /> sites are not named in the General Order but were used previously during a widening and deepening of <br /> the Stockton Deep Water Ship Channel project, they satisfy Discharge Specification C.1 of the General <br /> Order for use as DMD sites. Due to the lack of disposal capacity in McCormick Pit, the COE will use <br /> Augusto Pit which is on the Sacramento River side of Sherman Island. The COE will have to abide by <br /> Waste Discharge Requirements Order No. 88-143 for the Augusto Pit since the decant water will return <br /> to the Sacramento River. <br /> The NOI states that monitoring and discharge control at all disposal and levee maintenance sites will be <br /> accomplished in a manner that complies with the General Order. The NOI also states that the dredging <br /> contractor will develop the actual Disposal Plan, Water Quality and Testing Plan, and a Toxicity and <br /> Contaminant Reduction Plan as part of his dredging contract.
