Bankruptcy Rules , the Solicitation Procedures Order and <br /> further orders of the Court, and no other or further notice <br /> is or shall be required. <br /> 4 . Solicitation . Votes for acceptance or <br /> rejection of the Plan were solicited in good faith and <br /> complied with sections 1125 and 1126 of the Bankruptcy <br /> Code, Bankruptcy Rules 3017 and 3018, the Disclosure State- <br /> ment, all other applicable provisions of the Bankruptcy <br /> Code, and all other rules, laws, and regulations . <br /> 5 . Distribution . All procedures used to dis- <br /> tribute to the applicable holders of Claims and to tabulate <br /> the Ballots were fair and conducted in accordance with the <br /> Bankruptcy Code, the Bankruptcy Rules, the local rules of <br /> the Bankruptcy Court, and all other rules, laws, and regu- <br /> lations . <br /> 6 . Impaired Classes That Have Voted To Accept <br /> the Plan . As evidenced by the Voting Report, which certi- <br /> fied both the method and results of the voting, Class Five, <br /> Class Seven and Class Nine have each accepted the Plan <br /> pursuant to the requirements of sections 1124 and 1126 of <br /> the Bankruptcy Code. Thus, at least one impaired class of <br /> Claims has voted to accept the Plan. <br /> 6 <br />
