not entitled to receive or retain any property under the <br /> Plan and, therefore, are deemed to have rejected the Plan <br /> pursuant to section 1126 (8) of the Bankruptcy Code . Al- <br /> though section 1129 (a) (8) of the Bankruptcy Code has not <br /> been satisfied with respect to the classes, the Plan is <br /> confirmable because the Plan satisfies section 1129 (b) of <br /> the Bankruptcy Code with respect to Classes Eight and Nine. <br /> See paragraph 23 below. - <br /> 18 . Treatment of Administrative and Tax Claims <br /> (11 U. S .C . § 1129 (a) (9) ) . The treatment of Administrative <br /> Claims under Article II .A of the Plan, Priority Tax Claims <br /> under Article II .0 of the Plan, and Other Priority Claims <br /> under Article III . B. 1 of the Plan satisfies the require- <br /> ments of section 1129 (a) ( 9 ) (A) , (B) and (C) of the Bank- <br /> ruptcy Code, respectively. <br /> 19 . Acceptance by Impaired Class ( 11 U. S . C . <br /> §- 1129 (a) (10) ) . Classes Five, Seven and Nine are impaired <br /> classes of Claims that have voted to accept the Plan with <br /> respect to all of the Debtors, and, to the Debtors ' knowl- <br /> edge, do not contain "insiders" whose votes have been <br /> counted, thus satisfying section 1129 (a) (10) of the Bank- <br /> ruptcy Code. <br /> 13 <br />
