monitoring or other data generated by Respondent or on Respondent behalf in any way <br /> pertaining to work undertaken pursuant to this Order. Respondent shall submit all such <br /> data upon the request of DTSC. Copies shall be provided within seven (7) days of <br /> receipt of a written request from DTSC. Respondent shall inform DTSC at least seven <br /> (7) days in advance of all field sampling under this Order, and shall allow DTSC and its <br /> authorized representatives to take duplicates of any samples collected by Respondent <br /> pursuant to this Order. Respondent shall maintain a central depository of the data, <br /> reports, and other documents prepared pursuant to this Order. <br /> 6.12 Record Retention. All such data, reports and other documents shall be <br /> preserved by Respondent for a minimum of ten years after the conclusion of all <br /> activities under this Order. If DTSC requests that some or all of these documents be <br /> preserved for a longer period of time, Respondent shall either comply with that request <br /> or deliver the documents to DTSC, or permit DTSC to copy the documents prior to <br /> destruction. Respondent shall notify DTSC in writing at least six (6) months prior to <br /> destroying any documents prepared pursuant to this Order. <br /> 6.13 Government Liabilities. The State of California shall not be liable for <br /> any injuries or damages to persons or property resulting from acts or omissions by <br /> Respondent, or related parties specified in Section 6.26, Parties Bound, in carrying out <br /> activities pursuant to this Order, nor shall the State of California be held as party to any <br /> contract entered into by Respondent or its agents in carrying out activities pursuant to <br /> this Order. <br /> 6.14 Additional Actions. By issuance of this Order, DTSC does not waive the <br /> right to take any further actions authorized by law. <br /> 6.15 Extension Requests. If Respondent is unable to perform any activity or <br /> submit any document within the time required under this Order, Respondent may, prior <br /> to expiration of the time, request an extension of the time in writing. The extension <br /> request shall include a justification for the delay. All such requests shall be in advance <br /> of the date on which the activity or document is due. <br /> Page 20 of 25 <br />
