Each Discharger granted coverage under the Small Food <br /> Processor Waiver is required to submit an Annual Monitoring Report no later than 1 February r <br /> 1 <br /> of each year. :1 Pages 1-2 of the Small Food Processor Monitoring and Reporting Program <br /> contain a description of the information required in the Annual Report. A copy of the wavier F <br /> and associated Monitoring and Reporting Program is enclosed for your information. <br /> d <br /> r <br /> General Condition No. D7 of Resolution R5-2003-0106 states: <br /> All technical and monitoring reports submitted pursuant to this Wavier are required <br /> pursuant to CWC Section 13267. Failure to submit reports in accordance with _ <br /> schedules established by this Wavier, the attachments of this Wavier, or failure to <br /> submit a report of sufficient technical quality to be acceptable to the Executive Officer, <br /> Is may:subject.the-Discharger to_enforcement.action pursuant to CWC Section 93268. <br /> Section 13267 of the California Water Code states, in part: <br /> 1 <br /> in conducting an investigation specified in subdivision (a), the regional board may <br /> require,that any person who has discharged, discharges, oris suspected of having <br /> discharged or discharging, or who proposes to discharge waste within its region, or <br /> any citizen or domiciliary, or political agency or entity of this state who has t <br /> discharged, discharges, or is suspected of having discharged or discharging, or who <br /> proposes to discharge, waste outside of its region that could.affect the quality of <br /> waters within its region shall furnish, under penalty of perjury, technical or monitoring <br /> program reports which the regional board requires. The burden, including costs, of <br /> these reports shall bear a reasonable relationship to the need for the report and the <br /> benefits to be obtained from the reports. In requiring those reports, the regional <br /> board shall provide the person with a written explanation with regard to the need for <br /> California Environmental Protection Agency <br /> �a Recycled Paper <br />
