(GTI) appreciates your desire to see the investigation proceed in <br /> j a timely fashion and is willing to work cooperatively with you. However, our client is <br /> frustrated with the numerous personnel changes at your office that have necessitated the <br /> submittal of several work plans to accommodate changes in opinion on how to approach <br /> additional site characterization work at this site. <br /> In your February 14, 2003 letter correspondence you raise several issues that warrant a , <br /> written response. We will attempt to answer these concerns, however we would like to <br /> present some background information to clarify our position. <br /> I <br /> In the summer of 2000, GTI contacted Ms Donna Heran, the director of the SJC <br /> PHS/EHD for mitigation program information. Specifically, GTI requested written <br />` clarification on whether the use of the words "recommends" and "should" in written <br /> directives from Site Mitigation Unit are or are not lawful directives within the context of <br /> IF <br /> the UST regulations promulgated in the California Health and Safety Code (HSC), the <br /> California Code of Regulations (CCR), and in regards to the UST Cleanup Fund Program I <br /> (USTCFP). <br />
