I
Karen Petryna
Equiva Services,LLC
Page 3
II
agreement is valid or invalid, and in fact were simply trying to notify the property owner of the
impending work and asking if she was in agreement with that work. 4
Action item: Lori Duncan to.call Liz Franco and clarify that in her previous phone call she was
not saying that the access agreement was invalid but rather providing notification of the i
impending work.
Completed: Lori Duncan spoke to Liz Franco on the telephone. It is the County's understanding
that Ms.Franco's concern is'whether or not the access agreement is valid. Rather, her concern is
that the people who signed the access agreement, the Itens, are not the property owners. It is the
condominium association who owns the property, and the Itens own one of the condominiums.
Ms. Franco said she would contact Aubrey Cool of Cambria to discuss working out an agreement.
440 W Charter Way
The workplan will be approved including the destruction of monitoring well MW-16. However,
itis possible that MW-16 will need to be replaced. The decision to replace MW-16 will be based
on data from nearby sites(1426 and 1444 Charter Way).
Action item: Lori Duncan to complete evaluation of adjoining sites and issue workplan approval.
141 N El Dorado
There was a.general discussion regarding the MtBE contamination and whether or not the wells
that were destroyed in response to a request by the City of Stockton Redevelopment Agency need
to be replaced. Cambria presented graphs that suggest that a MtBE plume is migrating on site
from an off-site source. However, the RWQCB attended a meeting in 1999 with the City of
Stockton and stated in the meeting that they will not close a site with known groundwater
contamination that has not been defined and/or remediated, even if the contamination is from an
off-site source. Marty Hartzell of the Regional Board agreed that the source of the plume is likely I
not Shell, but added that as long as there is known groundwater contamination at the site that the
site could not be closed. Marty Hartzell said that the monitoring wells previously in place were
providing good information regarding trends in the plume. Ms.Petryna offered to complete
borings to show confirmation of site remediation instead of replacing the destroyed monitoring
wells. Marty Hartzell asked if.Equiva would prepare a closure report and Ms. Petryna. Marty
Hartzell stated that he would discuss the site further with his supervisor Ms. Cori Condon, and
with Margaret Lagorio. -
Action item: Marty Hartzell to discuss the site with Cori Condon and Margaret Lagorio, and
I
return a call to Cambria.
7
700 Moreland Court i
The initial letter that went out to the RP did not specifically state that the horizontal and vertical
extent of the MtBE contamination would need to be defined. A letter with that statement will be
sent to Shell within one week of the meeting. The soil will need to be investigated and at least
one grab groundwater sample will need to be collected.
