It is the County's understanding <br /> that Ms.Franco's concern is'whether or not the access agreement is valid. Rather,her concern is <br /> that the people who signed the access agreement, the Itens, are not the property owners. However, <br /> itis possible that MW-16 will need to be replaced. The decision to replace MW-16 will be based <br /> on data from nearby sites(1426 and 1444 Charter Way). <br /> Action item: Lori Duncan to complete evaluation of adjoining sites and issue workplan approval. <br /> 141 N El Dorado <br /> There was a.general discussion regarding the MtBE contamination and whether or not the wells <br /> that were destroyed in response to a request by the City of Stockton Redevelopment Agency need <br /> to be replaced. Cambria presented graphs that suggest that a MtBE plume is migrating on site <br /> from an off-site source. However,the RWQCB attended a meeting in 1999 with the City of <br /> Stockton and stated in the meeting that they will not close a site with known groundwater <br /> contamination that has not been defined and/or remediated, even if the contamination is from an <br /> off-site source. Marty Hartzell of the Regional Board agreed that the source of the plume is likely I <br /> not Shell,but added that as long as there is known groundwater contamination at the site that the <br /> site could not be closed. Marty Hartzell said that the monitoring wells previously in place were <br /> providing good information regarding trends in the plume. Ms.Petryna offered to complete <br /> borings to show confirmation of site remediation instead of replacing the destroyed monitoring <br /> wells. Marty Hartzell asked if.Equiva would prepare a closure report and Ms. Petryna. Marty <br /> Hartzell stated that he would discuss the site further with his supervisor Ms. Cori Condon,and <br /> with Margaret Lagorio. - <br /> Action item: Marty Hartzell to discuss the site with Cori Condon and Margaret Lagorio, and <br /> I <br /> return a call to Cambria. <br /> 7 <br /> 700 Moreland Court i <br /> The initial letter that went out to the RP did not specifically state that the horizontal and vertical <br /> extent of the MtBE contamination would need to be defined. A letter with that statement will be <br /> sent to Shell within one week of the meeting. The soil will need to be investigated and at least <br /> one grab groundwater sample will need to be collected. <br />
