The second paragraph in the letter from SJCPHS, attached for <br /> reference, specifically discusses a "new release" of product to the groundwater. This <br /> release has been manifested through the presence of high concentrations of MTBE, a <br /> compound that has only been added to gasoline recently. <br /> Based on the findings on MTBE in groundwater, it may be useful for you to hire a licensed <br /> tank and product line tester to ascertain the source of the MTBE release. Additionally, <br /> SJCPHS is requiring additional assessment work to be performed at the site due to this <br /> "new release". The obligation to perform all work related to this second release lies with you <br /> as the Buyer in accordance with Section 12.11 of the Purchase Agreement and Escrow <br /> Instructions which reads: <br /> The provisions of this Section shall not apply to any Contamination which is released upon or <br /> comes to exist on, at or under the Property after the Turnover Date which is not related to any <br /> Contamination existing prior to the Turnover Date or any of Seller's Clean-up actions (herein <br /> referred to as 'Subsequent Contamtnahon' . Buyer shall be solely responsible for any and all <br /> costs, Clean-up and Liabilities arising from or relating to any Subsequent Contamination <br /> Accordingly, we will need to meet with you and your environmental consultant to derive an <br /> appropriate course of action to perform corrective action at this site.
