MINER AVE., STOCKTON
This is to notify you that during the detailed review of your application, it was
erroneously determined that your claim was not eligible for reimbursement from the
Fund. We notified you on February 27, 2009, that your claim was to be suspended from
the Priority List because you had not complied with the UST permitting requirements.
On April 1, 2009, the Fund received your explanation and request for reinstatement for
placement on the Priority List. On April 3, 2009, the Fund received a letter of
clarification from Margaret Lagorio of the San Joaquin County Environmental Health
Department. Ms. Lagorio stated that there was conflicting information in the County
files for two separate tank systems in two different locations. During the file review at
the County, Fund staff incorrectly determined the tanks that are the subject of this claim
did not meet permitting requirements. This is to formally notify you that the previous
Notice of Intent to Suspend your claim dated February 27, 2009, is hereby rescinded.
Your claim will remain on the Priority List as previously recorded. We apologize for any
confusion or inconvenience.
If you have any questions, please contact me at (916) 341-7361.
Sincerely, y
 ✓ 1CL' k:
Lisa Labrado
Claims Review Unit
Underground Storage Tank Cleanup Fund
cc: Margaret Lagorio
San Joaquin County EHD
600 E.
