0 Station No.: 0187 <br /> SITE ACCESS AGREEMENT <br /> THIS SITE ACCESS AGREEMENT("AgreenrenP')is entered into and effective this <br /> 13th day of September,2007 ("Effective Date"),by and UNION OIL COMPANY OF <br /> CALIFORNIA,a California corporation("Unocar')and NAVIN PATEL ("0vaer"). <br /> RECITALS <br /> A. Owner holds record title to certain real property located at 322 North California <br /> Street,in the City of Stockton,County of San Joaquin,State of California(the"Property"); <br /> B. Unocal operated a retail s:-vice station at 437 East Miner Avenue,Stockton, <br /> California,commonly referred to by Unocal as Service Station No. 0817 (the"Station Property"); <br /> C. Unocal seeks Owner's authorization to access the Property to conduct any necessary <br /> environmental assessment and monitoring activities with respect to possible petroleum hydrocarbon <br /> contamination that may be present on or under the Property from the operation of retail service <br /> station facilities by Unocal (or its dealer)on the Station Property;and <br /> D. Owner is willing to grant Unocal access to the Property for the above-described <br /> purposes. <br /> TERMS AND CONDITIONS <br /> NOW, THEREFORE, in consideration of the mutual covenants and promises herein, <br /> the parties hereby agree as follows: <br /> 1. RIGHTS GRANTED <br /> Owner hereby grants to Unocal a license over, under and across the Property for <br /> the purpose of performing environmental assessment and monitoring activities (the "Work'. <br /> Said Work may include soil and groundwater sampling and the installation, maintenance, <br /> inspection, periodic sampling, replacement, and abandonment of groundwater monitoring wells. <br /> Unocal agrees to prepare a formal written Site Assessment Work Plan or equivalent document <br /> describing the Work to be performed, a copy of which will be provided to Owner. <br /> 2. PEFORMANCE OF THE WORK <br /> Unocal agrees,at its sole cost and expense,to conduct and perforin all its activities on the <br /> Property in a prompt, safe, efficient and workmanlike manner and in full and complete <br /> compliance with all applicable federal,state or local laws,regulations or ordinances. <br /> 3.
