RTD shall be responsible for <br />obtaining any permits, giving any notices or providing any reports required to properly <br />plug and abandon the borings or wells in accordance with all applicable laws and <br />regulations. <br />f. Post -drilling: To the extent necessary, access is granted for the San Joaquin <br />County Department of Health to inspect the boring locations to assure that they have <br />been adequately grouted and that they otherwise comply with applicable State and local <br />rules and regulations. <br />g. Right to Observe: OWNER and TENANT have the right, but not the <br />obligation, to observe the ACTIVITIES and obtain split samples for independent analysis. <br />RTD shall undertake the sampling only in the presence of such observers, unless <br />OWNER and TENANT have consented in writing to the conduct of such work without the <br />presence of observers, which consent shall not be unreasonably withheld or conditioned. <br />Nothing in this Agreement shall be interpreted as preventing OWNER or TENANT from <br />obtaining samples and conducting analyses independent of the Activities, <br />h. Copies: Complete and accurate copies of the results of all sampling, boring <br />logs, chain of custody documentation and any other information produced or developed <br />by RTD or its employees. contractors and subcontractors shall be provided to OWNER <br />and TENANT promptly, but no more than five (5) business days, after they are received <br />by RTD. RTD shall also provide to OWNER and TENANT, as soon as practicable after <br />receipt, copies of any notice of violation, citation, complaint or similar documentation <br />resulting from RTD's work under this Agreement. <br />2_ Timing and Notice of ACTIVITIES on the Sardee Portion of the Subject <br />Property. RTD shall conduct the entries and the ACTIVITIES on the Sardee Portion of the <br />Subject Property (i.e., the portion of the Property south of the existing eastfwest fence) <br />during the Feasibility Period in a manner that does not unreasonably interfere with the <br />operations of OWNER or TENANT on the Subject Property. RTD shall provide OWNER <br />AND TENANT written notice of its intent to enter the Sardee Portion of the Subject <br />Property to conduct Phase II activities not less than five (5) business days (Need this time <br />to make ready the areas for drilling once identified in 1.c ) prior to the planned entry <br />3 Building Access. No access to buildings, enclosures or other improvements <br />shall be permitted for the accomplishment of the ACTIVITIES other than as described in <br />the Scope of Work or expressly approve in writing by TENANT and OWNER. <br />4. Project Review Meeting. RTD and OWNER and TENANT will undertake a <br />Project Review Meeting with RTD representatives at TENANT'S facility to discuss the <br />schedule, the Scope of Work, and safety issues prior to coming onto the Subject Property. <br />In scheduling the work, RTD and its contractors will take all practicable precautions to <br />avoid interfering with TENANT'S production and operations. RTD's work schedule is <br />subject to TENANT'S approval, which TENANT will not unreasonably withhold. <br />5_ Compliance with Laws.
