I are pursuant to Health and Safety Code section 25516 hereby permanently enjoined from: <br /> 2 a. Violating Health and Safety Code section 25503.5(a),being a business that handles <br /> 3 a hazardous material or a mixture containing a hazardous material that has a quantity at any one time <br /> 4 during the reporting year equal to,or greater than, a total weight of 500 pounds, or a total volume of <br /> 5 55 gallons,or 200 cubic feet at standard temperature and pressure for compressed gas, failing to <br /> 6 establish and implement a business plan for emergency response to a release or threatened release of <br /> 7 a hazardous material for 2498 E. MAIN ST., 48 E. CHARTER WAY,340 N.WILSON WAY, <br /> 8 STOCKTON,CALIFORNIA and 400 E. LODI AVE., LODI, CALIFORNIA; <br /> 9 b. Violating Health and Safety Code section 25504(b),business plan failing to include <br /> 10 emergency response plans and procedures in the event of a reportable release or threatened release of <br /> 11 a hazardous material, including but not limited to the following: <br /> 12 1. Immediate notification to the San Joaquin County Office of Emergency <br /> 13 Services and to the appropriate local emergency rescue personnel; <br /> 14 2. Procedures for the mitigation of a release or threatened release to minimize <br /> 15- -any potential harm or damage to persons;property,or the-environment; <br /> 16 3. Evacuation plans and procedures, including immediate notice, for the <br /> 17 business site; <br /> 18 c. Violating Health and Safety Code section 25504(c), failing to train all new <br /> 19 employees and annual training, including refresher courses, for all employees in safety procedures in <br /> 20 the event of a release or threatened release of a hazardous material, including,but not limited to, <br /> 21 familiarity with the plans and procedures specified in Health and Safety Code section 25504(b); <br /> 22 d. Violating Health and Safety Code section 25505, failing to submit a business plan <br /> 23 for emergency response to a release or threatened release of hazardous material for the year 2007 for <br /> 24 2498 E. MAIN ST., 48 E. CHARTER WAY, 340 N. WILSON WAY, STOCKTON, CALIFORNIA <br /> 25 and 400 E. LODI AVE., LODI, CALIFORNIA, to the San Joaquin County Office of Emergency <br /> 26 Services. Further, it is alleged that said violation was knowingly committed after reasonable notice; <br /> 27 e. Violating Health and Safety Code section 25505(e)(2), failing to annually submit a <br /> 28 form,provided by the San Joaquin County Office of Emergency Services, that certifies that the <br /> 3 <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
