Therefore, it is being proposed that your claim be removed from the <br /> Priority List based on the following reason: <br /> On October 23, 2000, you were sent a letter requesting information necessary to prepare your <br /> Letter of Commitment(LOC). On March 21, 2001 the Fund received the requested documents <br /> with a change of address request and a different Federal Tax Identification Number(FEIN)than <br /> that submitted with the original application. Michael A. Caprio signed the original claim <br /> application and Amy Dietz signed the documents submitted. By letter dated June 27,2001, you <br /> were requested to submit an explanation of the different FEIN and provide authorization from a <br /> company official to sign documents on behalf of Stockton Scavenger. To date, we have not <br /> received a response to the June 27, 2001 letter. <br /> Petroleum Underground Storage Tank Cleanup Fund Regulations §2813.3(a)(2) states: <br /> -(a) A claim that has been placed on the priority list may be removed if: <br /> (2) the claimant fails to provide necessary documentation or information, or <br /> refuses to provide access to the site that is the subject of the claim to a <br /> regulatory agency." <br /> If you disagree with this Staff Decision, you may appeal to the Division Chief pursuant to <br /> Section 2814.1 of the Petroleum Underground Storage Tank Cleanup Fund Regulations.
