5 . 3 Reports <br /> All non-privileged site investigation reports, including <br /> but not limited to all quarterly groundwater monitoring <br /> reports, geological logs, sampling and analysis plans, <br /> reports and all other supporting data, shall be submitted <br /> to Owner within one week after the STTC submits the <br /> report (s) to the RWQCB. In addition, a copy of all non- <br /> privileged correspondence containing comments and/or other <br /> information pertinent to the Site, as generated by the <br /> Water Board or other part es, shall be provided to the Port <br /> as they are received by STTC. <br /> 6. Reservation of Right <br /> The parties to the Agreement understand and agree that <br /> execution of the Agreeme t was necessitated by action or <br /> threatened action of the Water Board, and that except as <br /> otherwise specifically pr vided herein, this Agreement does <br /> not constitute any admission of fact, law, responsibility, <br /> fault, or liability of any kind, nor shall it constitute a <br /> waiver or limitation of any legal right, claim or defense <br /> available to any party. <br /> 7 . Governing Law <br /> The interpretation and enforcement of this Agreement shall <br /> be governed by the laws of the State of California. <br /> 8 . Effective Date <br /> This Agreement shall be effective from and after the date <br /> on which the latter party executes it, as set forth below. <br /> 9 . Term of Agreement; Removal of Wells <br /> This Agreement shall term nate on a date 120 days after the <br /> Water Board notifies STTC that its obligation to monitor <br /> groundwater from Owner' s Property is complete. Within 30 <br /> days following such notice, STTC shall close and abandon <br /> all wells on Owner' s roperty in accordance with all <br /> applicable federal, tate, or local governmental <br /> requirements .
