R5-2015-XXXX <br /> CALIFORNIA WATER CODE SECTION 13267 <br /> FOR <br /> SFPP, L.P., OPERATING ENTITY OF <br /> KINDER MORGAN ENERGY PARTNERS, L.P. (KMEP) <br /> STOCKTON TERMINAL, 2947 NAVY DRIVE, STOCKTON <br /> SAN JOAQUIN COUNTY <br /> This Order is issued to SFPP, L.P., operating entity of Kinder Morgan Energy Partners, L.P. <br /> (KMEP) (hereafter referred to as Discharger) for the petroleum pumping station at 2947 Navy <br /> Drive in Stockton (Site). The Order is issued pursuant to California Water Code section 13267, <br /> which authorizes the Executive Officer of the California Regional Water Quality Control Board, <br /> Central Valley Region (hereafter Central Valley Water Board) to issue a Monitoring and <br /> Reporting Order (Order). T <br /> The Executive Officer finds: 1'K)\ <br /> INTRODUCTION <br /> 1. KMEP owns and operates the pumping facility at the Site and investigations have shown <br /> that elevated levels of total petroleum hydrocarbons as gasoline (TPHg), TPH as diesel <br /> (TPHd), benzene, toluene, ethylbenzene, and xylenes (collectively BTEX), methyl tert butyl <br /> ether (MTBE), and tertiary butyl alcohol (TBA) are present in groundwater at the Site. The <br /> Discharger is responsible for the discharge because it owned and/or operated the facilities <br /> at the times of the discharges. Groundwater flows to the northeast and depth to water <br /> ranges from about 3 feet below ground surface (bgs) to about 5 feet bgs. This pollution has <br /> impaired the beneficial use of groundwater resources at the Site. <br /> 2. This Monitoring and Reporting Order is issued by the Central Valley Water Board, pursuant <br /> to California Water Code (CWC) section 13267 and is necessary to delineate groundwater <br /> pollutant plumes. <br /> 3. Existing data and information about the Site show the presence of various chemicals, <br /> including TPHg, TPI-Id, BTEX, MTBE, and TBA emanating from the property resulting from <br /> the Discharger's current or past operation. The Discharger is responsible for the discharge <br /> because the discharger owns the property and operated a pumping facility on the Site. <br /> 4. The Discharger shall not implement any changes to this Order unless and until a revised <br /> Order is issued by the Executive Officer. This Monitoring and Reporting Order replaces the <br /> requirements listed in Order No. R5-2005-0815 which was issued on 22 April 2005. <br /> 5. Prior to construction of any new groundwater monitoring or extraction wells, and prior to IT <br /> destruction of any groundwater monitoring or extraction wells, the Discharger shall submit <br /> plans and specifications to the Central Valley Water Board for review and approval. Once <br /> installed, all new monitoring wells shall be added to the monitoring program and shall be <br /> sampled and analyzed according to the schedule provided under the 'Required Actions' <br /> section of this Order <br />
