R5-2015-XXXX
CALIFORNIA WATER CODE SECTION 13267
FOR
SFPP, L.P., OPERATING ENTITY OF
KINDER MORGAN ENERGY PARTNERS, L.P. (KMEP)
STOCKTON TERMINAL, 2947 NAVY DRIVE, STOCKTON
SAN JOAQUIN COUNTY
This Order is issued to SFPP, L.P., operating entity of Kinder Morgan Energy Partners, L.P.
(KMEP) (hereafter referred to as Discharger) for the petroleum pumping station at 2947 Navy
Drive in Stockton (Site). The Order is issued pursuant to California Water Code section 13267,
which authorizes the Executive Officer of the California Regional Water Quality Control Board,
Central Valley Region (hereafter Central Valley Water Board) to issue a Monitoring and
Reporting Order (Order). T
The Executive Officer finds: 1'K)\
INTRODUCTION
1. KMEP owns and operates the pumping facility at the Site and investigations have shown
that elevated levels of total petroleum hydrocarbons as gasoline (TPHg), TPH as diesel
(TPHd), benzene, toluene, ethylbenzene, and xylenes (collectively BTEX), methyl tert butyl
ether (MTBE), and tertiary butyl alcohol (TBA) are present in groundwater at the Site. The
Discharger is responsible for the discharge because it owned and/or operated the facilities
at the times of the discharges. Groundwater flows to the northeast and depth to water
ranges from about 3 feet below ground surface (bgs) to about 5 feet bgs. This pollution has
impaired the beneficial use of groundwater resources at the Site.
2. This Monitoring and Reporting Order is issued by the Central Valley Water Board, pursuant
to California Water Code (CWC) section 13267 and is necessary to delineate groundwater
pollutant plumes.
3. Existing data and information about the Site show the presence of various chemicals,
including TPHg, TPI-Id, BTEX, MTBE, and TBA emanating from the property resulting from
the Discharger's current or past operation. The Discharger is responsible for the discharge
because the discharger owns the property and operated a pumping facility on the Site.
4. The Discharger shall not implement any changes to this Order unless and until a revised
Order is issued by the Executive Officer. This Monitoring and Reporting Order replaces the
requirements listed in Order No. R5-2005-0815 which was issued on 22 April 2005.
5. Prior to construction of any new groundwater monitoring or extraction wells, and prior to IT
destruction of any groundwater monitoring or extraction wells, the Discharger shall submit
plans and specifications to the Central Valley Water Board for review and approval. Once
installed, all new monitoring wells shall be added to the monitoring program and shall be
sampled and analyzed according to the schedule provided under the 'Required Actions'
section of this Order
