CLEANUP AND ABATEMENT ORDER NO. 94-_ -3- <br /> SHELL OIL COMPANY <br /> STOCKTON TERMINAL <br /> SAN JOAQUIN COUNTY <br /> 13. The issuance of this Order is an enforcement action taken by a regulatory agency and is <br /> exempt from provisions of the California Environmental Quality Act, pursuant to <br /> Section 15321(a)(2), Title 14, California Code of Regulations. <br /> 14. Any person affected adversely by this action of the Board may petition the State Water <br /> Resources Control Board within 30 days of the date on which the Board took action. <br /> Copies of the law and regulations applicable to the filing of petitions will be provided <br /> on request. <br /> IT IS HEREBY ORDERED pursuant to Section 13304 and 13267 of the California Water <br /> Code, that Shell Oil Company shall: <br /> 1. Cleanup and abate, forthwith, the effects of petroleum products discharged to soils and <br /> ground water at this location. "Forthwith" means as soon as is reasonably possible. <br /> 2. Reports and work plans are to follow the soil and ground water investigation process <br /> described in the Tri-Regional Recommendations and its Appendices A and B which are <br /> made a part of this Order. Compliance with 1 above shall include, but not be limited <br /> to, the following measures: <br /> a. By the 30th of the month following the end of each calendar quarter, submit <br /> quarterly reports which provide information on the investigations, remediation <br /> systems operation, remediation activities, and results of ground water sampled and <br /> analyzed as specified in Monitoring and Reporting Program No. 94-801. <br /> Secondary Source Area (SSA) 3 Definition and Remediation <br /> b. By 1 August 1994, submit a work plan to define the horizontal extent of contami- <br /> nation in SSA 3. <br /> C. By 1 December 1994, submit a problem assessment report regarding the extent of <br /> contamination in SSA 3. <br /> d. By 1 April 1995, submit for Board approval a Final Remediation Plan for SSA 3 <br /> that is acceptable to the Board. <br /> e. Implement the Final Remediation Plan for SSA 3 within 60 days of approval by <br /> the Executive Officer. <br />
