• <br /> CLEANUP AND ABATEMENT ORDER _4_ <br /> LINCOLN PROPERTIES, LIMITED <br /> LINCOLN VILLAGE SHOPPING CENTER <br /> SAN JOAQUIN COUNTY <br /> board, or who has caused or permitted, causes or permits, or threatens to cause or permit any waste to <br /> be discharged or deposited where it is, or probably will be, discharged into waters of the state and <br /> creates, or threatens to create, a condition of pollution or nuisance, shall upon order of the regional <br /> board clean up such waste or abate the effects thereof or, in the case of a threatened pollution or <br /> nuisance, take other necessary remedial action." <br /> 23. Lincoln has caused or permitted waste to be discharged where it has <br /> discharged to ground water and has created a condition of pollution or <br /> nuisance. <br /> 24. Issuance of this Order is an enforcement action taken by a regulatory <br /> agency and is exempt from the provisions of the California Environmental <br /> Quality Act (Public Resources Code Section 21000, et seq. ) , pursuant to <br /> Section 15321(a)(2) , Title 14, of the California Code of Regulations. <br /> 25. Any person adversely affected by this action of the Board may petition the <br /> State Water Resources Control Board to review the action. The petition <br /> must be received by the State Board within 30 days of the date of which <br /> the Board took action. Copies of the law and regulations applicable to <br /> filing petitions will be provided upon request. <br /> IT IS HEREBY ORDERED pursuant to §13304 of the California Water Code, that <br /> Lincoln Properties, Ltd. shall forthwith clean up and abate the pollution and <br /> threatened pollution by taking all necessary actions. "Forthwith" means as soon <br /> as possible, but no later than the dates specified below. Actions to be taken <br /> include but are not necessarily limited to: <br /> 1. Conduct Phase III of the site investigation, as approved. The site <br /> investigation shall define the horizontal and vertical extent of soil and <br /> ground water contamination, both on and off the Shopping Center property, <br /> migrating from previously, presently, and potentially leaking sewer lines <br /> which are: <br /> a. on the Shopping Center property and <br /> b. off the Shopping Center property, and which transported wastes <br /> initially discharged to sewer lines underlying the Shopping Center <br /> property. <br /> The locations of samples containing no pollutants detectable by the EPA <br /> 600 Series analytical method shall define the vertical and lateral extent <br /> of soil and ground water pollution. <br /> 2.
