Incidents Giving Rise To This Claim: <br /> 10 On June 11, 1991, the claimants were served with a <br /> 11 summons and complaint seeking indemnity and contribution from <br /> 12 Lincoln Properties, Ltd. , a California limited partnership, which <br /> 13 owns Lincoln Center, a shopping center located in San Joaquin <br /> 14 County, California. <br /> 15 The complaint seeks, among other things, recovery of all <br /> 16 necessary response costs, contribution toward response costs and <br /> 17 remedial action, if necessary, express, implied contractual and <br /> 18 equitable indemnity and declaratory relief. The complaint alleges <br /> 19 that in late 1984 and early 1985 testing of drinking water wells <br /> 20 near Lincoln Center, which was mandated by state law, showed <br /> 21 contamination of the drinking water in those wells. Further <br /> 22 investigation by state and local agencies in 1985 and 1986 showed <br /> 23 ground water contamination at and emanating from Lincoln Center. <br /> 24 Claimants were long time tenants of the Lincoln Center <br /> 25 and operated a drycleaning business on that premises. <br /> 26 The contaminants discovered in the drinking water wells <br /> 27 located adjacent to Lincoln Center included, but were not limited <br /> 28 to, tetrachloroethylene (PCE) , trychloroethylene (TCE) and <br /> DONAHUE <br /> AND <br /> CALLAvAM <br /> SCN11.9 OWN 2 <br /> SU."
