1 (a) Public nuisance pursuant to California Civil Code <br /> 2 5§3480, et seq. ; <br /> 3 (b) Private nuisance pursuant to California Civil Code <br /> 4 §53481, et seq. ; <br /> 5 (c) Inverse condemnation (California Constitution <br /> 6 Article 1, §19) ; <br /> 7 (d) Dangerous condition of public property (Government <br /> 8 Code 5§835, et seq. ) ; <br /> 9 (e) Failure to discharge a mandatory duty (Government <br /> 10 Code 5815. 6) ; <br /> 11 (f) Breach of express and implied warranty. <br /> 12 (Jefferson, Inc. v. City of Torrance (1968) 266 Cal . App. 2d 300) ; <br /> 13 (g) Liability for negligence for acts and/or omissions <br /> 14 of independent contractors of the Health Services (Government Code <br /> 15 5815 . 4) ; <br /> 16 (h) Failure to warn; and <br /> 17 (i) Negligence. <br /> 18 The aforementioned causes of action and bases for <br /> 19 liability in connection with the presentation of this claim are <br /> 20 not exclusive of other claims or causes of action which may be <br /> 21 made against the Health Services in the event that this claim is <br /> 22 denied in whole or in part.
