Johnson, VP of <br /> Sims-Grupe Management Corp., Inc., at 615 Lincoln Center on Tuesday, June 2, 1998, <br /> at 9:30 Am to discuss the installation of SBs 115 and 116. <br /> Also, as agreed in the past, the areas near monitoring wells MW-7, MW-9, MW- <br /> 11, and MW-12 will not be accessed between 8:00 p.m. and 10:00 p.m., and the areas <br /> near MW-3 will not be accessed between 8:00 p.m. and 12:00 a.m., in order to <br /> minimize impact on nearby tenants which maintain business hours during these times. <br /> Additionally, the area near SB 117 should not be accessed before 10 PM to avoid <br /> conflicts with the patrons at Santiago's Restaurant located at 222 Lincoln Center. <br /> LPL requests that it be notified immediately if LFR encounters any non-routine <br /> circumstances during this construction event as LPL will be performing limited <br /> Oversight and Monitoring ("O&M") F-eiivities during May to August. <br /> The grant of access contained in this letter is conditioned upon the <br /> understanding that the work to be conducted by LFR will proceed with all deliberate <br /> haste, while simultaneously observing the requirement contained in the Permanent <br /> Injunction and the First Final Consent Decree that LFR on behalf of the Settling Dry <br /> Cleaning Defendants ("SDCDs") must, to the maximum extent practicable, not interfere <br /> with the operations of Lincoln Center or with the operations of the business of any <br /> tenant of Lincoln Center. <br /> In conclusion, LPL is granting the LFR access for these activities as an <br /> accommodation to the Special Master, in spite of the fact that the Special Master has <br /> not determined that the SDCDs are in full compliance with the insurance requirements <br /> of the Permanent Injunction and the First Final Consent Decree. In the event that the <br /> Special Master determines that additional or modified insurance is required to satisfy <br /> the provisions of the applicable Orders, this grant of access will be conditioned upon <br /> the SDCDs' making every effort to have that insurance in place prior to completing the <br /> pending work by LFR. <br /> Please contact me at (209)472-9200 should you have any questions or concerns <br /> regarding this grant of access.
