• <br /> TENTATIVE WASTE DISCHARGE REQUIREMENTS ORDER NO. R5-2003-OOXX 4 <br /> LINCOLN CENTER ENVIRONMENTAL REMEDIATION TRUST <br /> SAN JOAQUIN COUNTY <br /> by reference plans and policies adopted by the State Water Resources Control Board (State <br /> Board). These requirements implement the Basin Plan. <br /> 16. Surface water drainage is to the San Joaquin River. The beneficial uses of the San Joaquin <br /> River are municipal and domestic supply; agricultural irrigation and supply; process and <br /> service industrial supply; contact recreation; other non-contact recreation; freshwater <br /> habitat, migration, spawning, and wildlife habitat. <br /> 17. The beneficial uses of underlying groundwater are domestic, municipal, agricultural <br /> supply, and industrial service and process <br /> 18. Surrounding land uses are commercial and residential. <br /> 19. State Water Resources Control Board (SWRCB) Resolution No. 68-16 (hereafter <br /> Resolution 68-16 or the"Antidegradation Policy") requires the Board in regulating the <br /> discharge of waste to maintain high quality waters of the state until it is demonstrated that <br /> any change in quality will be consistent with maximum benefit to the people of the State, <br /> will not unreasonably affect beneficial uses, and will not result in water quality less than <br /> that described in the Board's policies (e.g., quality that exceeds WQOs). <br /> 20. The Board finds that some degradation of groundwater by the GZVI may occur. The <br /> discharger has calculated that the complete reduction of PCE in the historical source, based <br /> on an average PCE concentration of 9,300 ug/l, would result in an increase in chloride <br /> concentrations of 8 mg/l. The additional chloride would result in chloride concentrations <br /> below the WQL for chloride and an increase in groundwater TDS levels of about 1 percent. <br /> Dissolved iron concentrations may increase although the concurrent production of OH- will <br /> result in the precipitation of ferrous hydroxide. Such degradation is consistent with <br /> Resolution 68-16 since (1) the purpose of the discharge of GZVI is to accelerate and <br /> enhance remediation of the groundwater pollution and such remediation will benefit the <br /> people of the state; (2) the discharge as allowed in this Order is a pilot project to evaluate <br /> the effectiveness and is limited in scope and duration; (3) this Order requires use of best <br /> practicable treatment, including adequate monitoring and contingency plans to assure <br /> protection of water quality; and (4) does not allow discharges of waste to exceed water <br /> quality objectives other than those temporarily permitted by these WDRs. <br /> 21. Section 13267(b) of California Water Code provides that: "In conducting an investigation <br /> specified in subdivision (a), the regional board may require that any person who has <br /> discharged, discharges, or is suspected of discharging, or who proposes to discharge within <br /> its region, or any citizen or domiciliary, or political agency or entity of this state who has <br /> discharged, discharges, or is suspected of discharging, or who proposes to discharge waste <br /> outside of its region that could affect the quality of the waters of the state within its region <br /> shall furnish,under penalty of perjury, technical or monitoring program reports which the <br /> board requires. The burden, including costs of these reports, shall bear a reasonable <br /> relationship to the need for the reports and the benefits to be obtained from the reports." <br />
