CEASE AND DESIST ORDER NO. -4- <br /> WOODBRIDGE PARTNERS INC. <br /> VICTOR FINE FOODS FACILITY <br /> SAN JOAQUIN COUNTY <br /> Closure As a Landfill—that all residual wastes, including sludges, <br /> precipitates, settled solids, and liner materials, shall be compacted, <br /> and the Unit shall be closed as a landfill pursuant to 421090, <br /> provided that the closed Unit meets applicable standards for landfill <br /> Units in Articles 3 and 4 of Subchapter 2, Chapter 3, Subdivision 1 of <br /> this division (/20240 et seq), and further provided that the moisture <br /> content of residual wastes, including sludges, does not exceed the <br /> moisture holding capacity of the waste either before or after <br /> closure;" <br /> 9. California Water Code Section 13301 states, in part, that: "When a regional board finds <br /> that a discharge of waste is taking place or threatening to take place in violation of <br /> requirements or discharge prohibitions prescribed by the regional board or state board, <br /> the board may issue an order to cease and desist and direct that those persons not <br /> complying with the requirements or discharge prohibitions (a) comply forthwith, (b) <br /> comply in accordance with a time schedule set by the board, or(c) in the event of a <br /> threatened violation, take appropriate remedial or preventive action." <br /> 10. As designated in the Water Quality Control Plan for the Sacramento and San Joaquin <br /> River Basins (Basin Plan), the beneficial uses of groundwater are municipal, domestic, <br /> irrigation, stock watering, and process supply. <br /> 11. Issuance of this Order is exempt from the provisions of the California Environmental <br /> Quality Act(Public Resources Code Section 21000, et seq.), in accordance with Title 14, <br /> California Code of Regulations, Section 15321(a)(2). <br /> 12. Any person adversely affected by the action of the Regional Board may petition the State <br /> Water Resources Control Board (State Board) to review the action. The petition must be <br /> received by the State Board within 30 days of the date the Regional Board adopted this <br /> Cease and Desist Order. Copies of the law and regulations applicable to filing petitions <br /> will be provided on request. <br /> 13. On in Sacramento, California, after due notice to the Discharger and other <br /> affected persons, the Regional Board conducted a public hearing at which the Discharger <br /> appeared and evidence was received concerning the discharge. <br /> IT IS HEREBY ORDERED that pursuant to California Water Code, Section 13301 and <br /> Section 13267, Woodbridge Partners Inc. shall: <br /> 1. Cease and desist, forthwith, from violating the requirements of Waste Discharge <br /> Requirements Order No. 5-01-057. <br />
