(ERI) has not received <br /> encroachment permits from the City of Stockton for the wells proposed in the Work Plan <br /> submitted on behalf on Unocal dated November 12, 1998, as modified by the Addendum to <br /> Work Plan submitted December 9, 1998 (collectively, the "Work Plan"). In addition, Unocal <br /> has not yet received a response from Stone Brothers and Associates to its request for additional <br /> access to the former Unocal site. ERI understands that the drilling permits cannot be issued <br /> until the encroachment permit is approved for the drilling in the City right-of-way or the access <br /> agreement is completed for the drilling of the borings on the former Unocal property (i.e., the <br /> Stone Brothers property). <br /> Mr. Jason Ender of the City of Stockton Public Work Department— Permit Center (Public <br /> Works) has indicated that the encroachment permit will not be approved till the end of the week <br /> of January 18, 1999. Unocal has made changes to its request for additional access from Stone <br /> Brothers and is awaiting signature from them. <br /> Since the necessary approvals have not been obtained, ERI will not be commencing drilling <br /> activities during the week of January 18, 1999 for this project. ERI has tentatively rescheduled <br /> the drilling for the week of January 25, 1999. If any of the approvals have not been obtained <br /> by January 22, 1999, drilling will have to be postponed until a later date when all requirements <br /> have been satisfied and a driller can be rescheduled. <br /> ERI has worked diligently in obtaining the necessary permits and access documents to <br /> commence drilling as soon as possible. As indicated earlier, Unocal and ERI remain committed <br /> to doing this work as soon as possible.
