CA 95827-3098 RECEIVED <br /> E C E IV E <br /> 1!L'1j5 August 1990 <br /> Mr. Morris Allen, Director AUG 17 1990 <br /> Department of Municipal Utilities <br /> City of Stockton ENVIRONMENTAL HEALTH <br /> 2500 Navy Drive PERM ITI'SERVICES <br /> Stockton, CA 95206 <br /> NOTICE OF VIOLATION, CITY OF STOCKTON EFFLUENT BIOTOXICITY, SAN JOAQUIN COUNTY <br /> We have reviewed the 1989-90 Biotoxicity Technical Report submitted by the City <br /> of Stockton and find that the City has not made significant progress in <br /> completing the TIE/TRE work requested by the Board. As a result, the City is <br /> expected to discharge effluent which will be acutely toxic to test fish and <br /> invertebrate species again this winter, in violation of waste discharge <br /> requirements. <br /> The report, prepared by Engineering Science, dated June 1990, summarized Toxicity <br /> Identification Evaluation (TIE)/Toxicity Reduction Evaluation (TRE) work <br /> completed by the City during the winter of 1989/90, and recommended a Plan of <br /> Study for further TRE work. The enclosed memorandum outlines specific comments <br /> and recommendations. <br /> Pursuant to Section 13267 of the Water Code, you are required to submit a <br /> Technical Report by 7 September 1990, outlining your 1990/1991 TIE/TRE plan for <br /> Golden Shiners and your plan for Ceriodaphnia. The overall objective is to <br /> eliminate all fish bioassay violations and all acute Ceriodaphnia toxicity in <br /> undiluted effluent by 1 October 1991 . The interim goal is to determine, by <br /> 1 May 1990, either the chemical (s) causing fish and invertebrate toxicity or <br /> develop and demonstrate an implementable treatment option which will meet the <br /> overall objective of eliminating toxicity. The reports must take into account <br /> the recommendations contained in the memorandum. <br /> We are preparing a Cease and Desist Order with a time schedule for the toxicity <br /> work which we plan to present to our Board at its regular meeting on 28 September <br /> 1990 in Sacramento.
