WASTE DISCHARGE REQUIREMENTS -6- <br /> CITY OF STOCKTON <br /> MAIN WATER QUALITY CONTROL PLANT <br /> SAN JOAQUIN COUNTY <br /> 11. The discharge shall not cause a violation of any applicable water <br /> quality standard for receiving waters adopted by the Board or the <br /> State Water Resources Control Board as required by the Federal Water <br /> Pollution Control Act and regulations adopted thereunder. If more <br /> stringent applicable water quality standards are approved pursuant to <br /> Section 303 of the Federal Water Pollution Control Act, or amendments <br /> thereto, the Board will revise and modify this order in accordance <br /> with such more stringent standards. <br /> C. Provisions: <br /> 1. Neither the discharge nor its treatment shall create a nuisance or <br /> pollution as defined in Section 13050 of the California Water Code. <br /> 2. If future studies indicate that additional nitrogen removal is <br /> necessary to protect water quality, the Board may revise and modify <br /> this Order to include more stringent nitrogen limitations. <br /> 3. The Discharger shall diligently pursue and enforce source control of <br /> Total Dissolved Solids (TOS) to minimize the level of TOS discharged. <br /> 4. The Discharger shall comply with all the items of the "Standard <br /> Provisions and Reporting Requirements (NPDES)", dated 1 August 1984, <br /> which are part of this Order. <br /> 5. The Discharger shall comply with all pretreatment requirements <br /> contained in 40 CFR Part 403 and shall be subject to enforcement <br /> actions, penalties , fines and other remedies by EPA or other <br /> appropriate parties, as provided in the Clean Water Act, as amended. <br /> The Discharger shall implement and enforce its approved Publicly-Owned <br /> Treatment Works (POTW) Pretreatment Program which is hereby made and <br /> enforceable condition of these requirements . EPA may initiate <br /> enforcement action against an industrial user for noncompliance with <br /> applicable standards and requirements as provided in the Clean Water <br /> Act. <br /> 6. The Discharger shall enforce the requirements promulgated under <br /> Sections 307(b) , (c ) , (d) , and 402( b) of the Clean Water Act. The <br /> Discharger shall cause industrial users subject to federal categorical <br /> standards to" achieve compliance no later than the date specified in <br /> those requirements or, in the case of a new industrial user, upon <br /> commencement of the discharge. <br />
