ADMINISTRATIVE CIVIL LIABILITY COMPLAINT -2- <br /> IN THE MATTER OF CITY OF STOCKTON <br /> REGIONAL WASTEWATER CONTROL FACILITY <br /> SAN JOAQUIN COUNTY <br /> The City of Stockton is hereby given notice that: <br /> 1. I am proposing that administrative civil liability be imposed in the <br /> amount of 850,000.00 based upon a review of the following factors: <br /> The nature, circumstance, extent, and gravity of the violation or viola- <br /> tions, whether the discharge is susceptible to cleanup or abatement, and, <br /> with respect to the violator, the ability to continue in business, any <br /> voluntary cleanup efforts undertaken, any prior history of violations, the <br /> degree of culpability, economic savings, if any, resulting from the <br /> violation, and such other matters as justice may require (Water Code <br /> Section 13327) . <br /> 2. A hearing on this matter may be scheduled by the Regional Board on 23 <br /> August 1985. <br /> 3. If a hearing is held, the Regional Board will consider whether to affirm, <br /> reject, or modify the proposed administrative liability, or whether to <br /> refer the matter to the Attorney General for recovery of judicial civil <br /> liability. <br /> 4. In lieu of a hearing, the City may waive the right to a hearing. Any <br /> waiver will not be effective until 30 days from the date of this complaint <br /> to allow other interested persons to comment on this action. If you wish <br /> to waive the hearing, please check and sign the waiver and return it and <br /> the amount of the civil liability to the Regional Board office, within 30 <br /> days. <br /> W SL 06 <br /> W LLIAM H.
