However, to investigate the soil contamination that <br /> has been inferred four additional soil borings are being proposed. <br /> 2. Residual soil and groundwater contamination act as a nuisance to the <br /> people of San Joaquin County per San Joaquin County Development <br /> Title Chapter 9-1125, Water Quality Regulations and the State of <br /> California Water Code Division 7, Chapter 2 (m). <br /> Hydrocarbons underlying the site act as a potential nuisance to the <br /> people of San Joaquin County. Although these hydrocarbons exist at <br /> low concentrations, use or contact of these hydrocarbon-affected <br /> media with the public is non-occurring. ' <br /> To ensure that the hydrocarbon impact does not act as a nuisance to <br /> the people of San Joaquin County, engineered health and safety <br /> management controls (previously referred to as institutional controls) <br /> should be put into effect at the site. These controls may consist of the <br /> following: 1) monitoring the containment of the dissolved <br /> hydrocarbons that underlay the site through a network of monitoring <br /> wells, 2) regular analyses of groundwater parameters to confirm the <br /> remediation of hydrocarbons through natural processes, 3) <br /> documentation which demonstrates no foreseeable land use changes <br /> that would allow public use or contact of the potential nuisance, and 4) <br /> the Water Code; The Water Code provides enforcement mechanisms <br /> in the case that clean up criteria are not appropriately implemented. <br /> 5.0 REMEDIATION <br /> 5.1 Remedial Objectives <br /> 1. Acceptable soil and groundwater objectives have not been estab- <br /> lished There is no legal way to achieve institutional controls. <br /> It is PACMIC's opinion that reasonable and stringent water quality <br /> goals were proposed in the CAP and engineered health and safety <br /> management controls can be achieved as previously discussed. <br /> 32013 570CAPLET.DOC.doe <br />
