PHS/EHD has prepared comments for your consideration
and response.
PHS/EHD requested in correspondence dated November 21, 1997 that a more detailed plan be submitted to
perform interim remediation. PHS/EHD was informed by your telephone message of December 10, 1997 that
soil would be excavated which was obviously saturated or where emergency conditions were encountered. You
indicated also that the former piping would be addressed and removed, if possible and that any necessary
oxygenate sampling would be performed. You requested information regarding the sufficiency of your telephone
message.
Until such time as a plan is submitted and implemented to determine the vertical and horizontal extent of any
contamination evidenced, the plan will not be approved for the installation of the new product piping in areas
where contamination is evidenced and the extent of such contamination is unknown.
Pursuant to the California Code of Regulations§2652 Reporting,Investigation, and Initial Response Requirements
for Unauthorized Releases (c) Within five working days of detecting an unauthorized release, the owner or
operator shall submit to the local agency a full written report which shall include but not be limited to
information pertaining to a description of the corrective and remedial actions, including investigations which
were undertaken and will be conducted to determine the nature and extent of soil, groundwater water,or surface
water contamination due to the release.
PHS/EHD must reiterate that problems have already been encountered when attempting to investigate the
suspected release associated with the dispensers and/or product piping, and that in an effort to constrain costs
associated with the investigation,PHS/EHD will not approve the installation of product piping in contaminated
areas, until the vertical and horizontal extent of the contamination has been determined.
If you have any questions,do not hesitate to contact me at (209) 468-0337.
Donna Heran,REHS, Director
Environmental Health Division
Mary Meays,Senior REHS Margaret gorio, REHS
Site Mitigation Unit Supervisor
cc: Pat Anderson,CVRWQCB
cc: David Irey,San Joaquin County District Attorney's Office
cc: Wilbur Smith,Sims-Grupe Management, 615 Lincoln Center,Stockton CA 95207
cc: Greg Barclay,Pacific Environmental
cc: Donald Bradshaw, Levine-Fricke-Recon
cc: UST File
A Division of San Joaquin Counry Health Care Services
