0
Regarding the text in your letter concerning the
discussions which take place at the RPM meetings, we remind DLA
that, per Section 9 . 1 of the Federal Facility Agreement (FFA) :
timetables, deadlines and schedules shall be extended upon
receipt of a timely request for extension and when good cause
exists for the requested extension. Any request for extension by
a Party shall be submitted to the other parties in writing
[emphasis added] and shall specify:
(a) the timetable, deadline or schedule that is sought to be
extended;
(b) the length of the extension sought:
(c) the good cause(s) for the extension; and
(d) the extent to which any related timetable and deadline or
schedule would be affected if the extension were granted.
Please know that discussions at RPM meetings, however
cordial, do not obviate the need for this written record. EPA
and DLA are both subject to occasional federal audits and EPA
has been criticized in the past for allowing extensions of the
enforceable schedule without sufficient basis. A written record
of justification will serve the interests of both of our
offices .
Please feel free to contact me at 415-744-2411 or Michael
Work at 415-744-2392 if you have any questions or comments .
Sincerely,
i
Rich Seraydarian, Chief
Army and Pacific Islands Section
Federal Facilities Cleanup Office
Superfund Division (SFD-8-3)
CC: (See Distribution List)
2
