RIGHT-OF-ENTRY FOR CONSTRUCTION Sharpe Army Depot Well 0523 6 524 Installation Restoration Program (Proleet,Installation or Aesidry) (7tiaet Number or Other Propos?'ldrnrljfeariOh The undersigned, hereinafter called the "Dwner," in consideration of the total compensu":on to be.. paid by the UNITED STATES OF AMERKA, hereinafter called the "Government," for til land or easement rights hereinafter described, to `a determined by subsequent agr,ecment betwv:n the Owner and the Government, or by judicial pr:ceedings, hereby grants to the Government, a :ermit or right-of-entry upon the following terms and :onditions: I. The Owner hereby grants to the Geiarnment an irrevocable right to enter upon the lands hereinafter described at any time within a per):d of eighteen ( 18 ) months from tic date of this instrument, in order to erect building or any other type of improvements and to p:rform construction work of any nature. 2. This permit includes the right of rgress and egress on other lands of the Owner not described below, provided that such ingress a_d egress is necessary and not otherwise convertently available to the Government. 3. All tools, equipment, buildings, imFr.-Dvements, and other property taken upon or placed upon the land by the Government shall remair :.he property of the Government and may be runoved by the Governmenj at any time within a rerJonable period after the expiration of this pernit or right-of-entry. 4. The Government shall have the rig...' to patrol and police the lands hereinafter de>tiribed during the period of this permit or rightof-entr? 5. If aircraft flights over said lands, or entry upon the land by means of helicopter o-, other type. aircraft, are necessary, the Government rill inform the Owner, in advance, of each suck Flight or entry. 6. It is understood and agreed that if the Government does not acquire title or other necessary interest in said land prior to the expiration of his permit or right-of-entry, or any renewal Hereof, the Government agrees to be responsible for ani damage arising from the activity of the Government, its employees and/or contractors on said lads, in the exercise of rights under this pernit or nght•of-entry, and shall repair such damages,or in lieu thereof and at the option of the Government, shall make an appropriate settlement with the C•krier.
