DDRW-WB PAGE 2 15 Nov 91 <br /> Ms. Antonia K. J. Vorster <br /> 3) A meeting with Mr. Lewis is being set up for the week of 21 <br /> November 1991. The purpose of this meeting is to obtain from Mr. Lewis tie <br /> cost of his damages, if any, caused by the discontinuance of the wells he <br /> currently uses. This is a very involved matter as Mr. Lewis has been <br /> reluctant to shut down his wells. He has also been reluctant to identify the <br /> nature of his interest in the property he now farms. <br /> 4) It is known that Mr. Lewis now farms land owned by five different <br /> landowners. When Mr. Lewis was asked whether he had any type of lease o <br /> other arrangement with these landowners, he was less than forthcoming. He <br /> alluded that it was not any of our business. Upon further discussing th <br /> matter, he did say that he has a written lease with one owner and a verbfl <br /> lease with another. No information relative to the remaining landowners was <br /> offered or obtained. It may be that Mr. Lewis is no more than a license( or <br /> at will tenant on the remaining land. <br /> 5) Obtaining this information is vital to compensating Mr. Lewis for <br /> his legitimate losses. Also, Mr. Lewis has agreed to identify costs <br /> associated with potential lost crops. Once again, Mr. Lewis must give u5 <br /> this information before we can make an offer to him for his damages, if any. <br /> Mr. Lewis has repeatedly refused to shut down his pumping operations until we <br /> reach an agreement. Unfortunately, the necessity to discontinue his pumping <br /> operations will most certainly precede the final monetary settlement of this <br /> matter. <br /> 6) To expedite the matters discussed above, letters are being sent to <br /> all the landowners, asking for their support in shutting down Mr. Lewis' <br /> pumping operation. They are also being asked to identify the property <br /> agreement, if any, they have with Mr. Lewis. They will also be informed of <br /> the Board' s desire that the wells be shut down. Finally, they will be <br /> informed that Mr. Lewis' s operation may make them liable as a potentially <br /> responsible party for any exacerbation of the contamination problem caused by <br /> the pumping. <br />
