NOTICE OF PUBLIC COMMENT PERIOD <br /> on a Land Use Restriction Agreement <br /> for North Country Squires <br /> The California Department of Toxic Substances Control, Lyon <br /> Construction, Inc. , and Verner Construction, Inc. are requesting <br /> public comment upon their agreement to restrict specified uses on <br /> land known as North Country Squires (the Property) . <br /> The Property is located north of Squires Road and east of Harlan <br /> Road in the City of Lathrop, San Joaquin County. The Property is <br /> located adjacent to the Defense Logistics Agency, Defense <br /> Distribution Region west, Sharpe Site, formerly known as the Sharpe <br /> Army Depot. <br /> Ground water contamination from the Defense Logistics Agency, <br /> Defense Distribution Region West, Sharpe Site has migrated offsite <br /> and is under portions of the Property. Lyon Communities, Inc, <br /> intends to construct a residential development known as North <br /> Country Squires on the Property. To ensure that future residents <br /> of the Property are not exposed to contaminated ground water, the <br /> agreement will restrict the following uses of the Property: <br /> 1. No owner or occupant of this Property shall extract, <br /> utilize, consume or permit to be extracted any water from <br /> below the surfaces of the ground without prior approval <br /> from the local Health District and the Department of <br /> Toxic Substances Control . <br /> 2 . All water utilized within the Property for any purpose <br /> shall be obtained from a municipal water source, unless <br /> approval from the local Health District and the <br /> Department of Toxic Substances Control is obtained. <br /> 3 . Prior to construction on the Property, all existing <br /> domestic and irrigation supply wells shall be abandoned <br /> pursuant to all applicable state and local regulations. <br /> However, ground water wells, extraction systems, and <br /> associated equipment used for monitoring or other <br /> purposes by the Defense Logistics Agency, Defense <br /> Distribution Region West, Sharpe Site, or it's agents or <br /> successors, shall remain intact. <br /> A copy of the agreement is available for public review at the: <br /> Manteca Public Library <br /> 320 W.
