As stated in the California Water <br /> Code, Division 7, (Porter-Cologne Water Control Quality Act) Section 13001: <br /> "It is the intent of the legislature that the state Board and each <br /> regional board shall be the principal state agencies with the primary <br /> responsibility for the coordination and control of water quality. The <br /> state board and the regional board in exercising any power granted in <br /> this division shall conform to and implement the policies of this <br /> chapter and shall, at all time, coordinate their respective activities <br /> so as to achieve a unified and effective water quality control program <br /> in this state. " <br /> This section makes the Board the lead state agency responsible for water <br /> quality. The Boards ARARs are designed to protect the water quality of the <br /> State. They should be used in the evaluation and determination of best <br /> technologies to remediate contamination at this site and should also be used <br /> in the remedy selection process. We are hereby submitting our ARARs. <br /> Water Code Section 13304 authorizes Regional Boards to require complete <br /> cleanup of all waste discharged and restoration of all affected water. State <br /> Water Resources Control Board (State Board) Resolution 68-16 requires the <br /> continued maintenance of high quality waters of the state even where that <br /> quality is better than needed to protect beneficial uses, unless specific <br /> findings are made. Water quality may not be allowed to be degraded below what <br /> is necessary to protect beneficial uses. Title 23 of the California Code of <br /> Regulation (CCR) , Chapter 15 of Division 3 regulates the discharge of waste to <br /> land for treatment, storage, and disposal and establishes siting, containment, <br /> monitoring, closure standards and corrective action, where necessary. Chapter <br /> 16 regulations allow the Regional Board to provide oversite of cleanup <br /> activities with leaking underground fuel storage tanks. Water Code <br /> Section 13304, Chapter 15 (applicable sections) , Chapter 16, and State Board <br /> Resolution 68-16 are applicable requirements as further described in the <br /> attached memorandum. <br />
