Upon request, and prior to ri­snlvinq the <br /> dispute, the Administrator shall meet and confer with the Army Secretariat <br /> Representative, the Executive Officer of the RWQCB, and DOHS's Deputy <br /> Director of the Toxic Substances Control Division to discuss the issue(s) <br /> under dispute. Upon resolution, the Administrator shall provide the other <br /> Parties with a written final decision setting forth resolution of the <br /> dispute. The duties of the Administrator set forth in this Section shall <br /> not be delegated. <br /> 13.8 Wherever in this Section unanimity of decision among the Parties is <br /> required for resolving disputes, OOHS and RWQCB, as agencies of the State of <br /> California, shall have one vote between them regardless of the fact that <br /> they may have more than one representative representing them at the par- <br /> ticular stage of dispute resolution. It shall be their responsibility to <br /> determine who shall cast their vote on their behalf. <br /> 13.9 The pendency of any dispute under this Section shall not affect SHAD'S <br /> responsibility for timely performance of the work required by this <br /> Agreement, except that the time period for completion of work affected by <br /> such dispute shall be extended for a period of time usually not to exceed <br /> the actual time taken to resolve any good faith dispute in accordance with <br /> the procedures specified herein. All elements of the work required by this <br /> Agreement which are not affected by the dispute shall continue and be com- <br /> pleted in accordance with the applicable schedule. <br /> 13.10 When dispute resolution is in progress, work affected by the dispute <br /> will immediately be discontinued if a DRC member requests, in writing, that <br /> work related to the dispute be stopped because, in his or her opinion, such <br /> -28- <br />
