the comment period. <br /> 3.3. 1. 3 fhe Parties shall review Lhe coimnents and shall either: <br /> 33.1.3.1 Determine that this Agreement should be made effective <br /> in its present form, in which case EPA shall notify all Parties in writing <br /> and this Agreement shall become effective on the date that SHAD receives <br /> such notification; or, <br /> 33.1.3.2 Determine that modification of this Agreement is <br /> necessary, in which case the Parties shall meet to discuss and agree upon <br /> any proposed changes. Upon agreement of any proposed changes, the <br /> Agreement, as modified, shall be re-executed by the Parties, with EPA sign- <br /> ing last, and shall become effective on thedatethat it is signed by EPA. <br /> 33.2 In the event a Party determines that it is necessary to modify this <br /> Agreement as a result of public comment received, and there is disagreement <br /> among the Parties as to the need for such modification, the Party proposing <br /> the modification may submit the disagreement to dispute resolution provided <br /> for in Section 13. <br /> 34. FUNDING <br /> 34. 1 It is the expectation of the Parties to this Agreement that all <br /> obligations of SHAD arising under this Agreement will be fully funded. SHAD <br /> agrees to seek sufficient funding through the DOD budgetary process to ful - <br /> fill its obligations under this Agreement. <br /> 34.2 In accordance with Section 120(e)(5)(B) of CERCLA, 42 U.S.C. <br /> 9620(e)(5)(B), the Department of the Army shall include in its annual report <br /> to Congress the specific cost estimates and budgetary proposals associated <br /> -49- <br />
