Title 22, CCR, Sections 66305 (b) and 66471: <br /> SHAD failed to determine whether the sludge wastes <br /> produced at the IWTP should be classified as <br /> hazardous prior to a disposal of the sludge which <br /> occurred on or about September 20-21, 1989 . <br /> 3 . Title 22, CCR, Section 66472 (c) : <br /> SHAD offered IWTP sludge, identified in its Waste <br /> Analysis Plan as a hazardous waste and later <br /> confirmed by certified laboratory analysis performed <br /> on November 7 , 1989 as hazardous, to a transporter <br /> who did not possess an EPA identification number. <br /> The transporter subsequently moved the sludge to the <br /> Stockton POTW for disposal on or about <br /> September 20-21, 1989 . <br /> 4 . Title 22, CCR, Section 66480 (a) : <br /> SHAD failed to prepare a manifest for transportation <br /> of IWTP sludge waste, identified in its Waste <br /> Analysis Plan as a hazardous waste and later <br /> confirmed by analysis as hazardous, offsite for <br /> disposal . <br /> The unmanifested load of sludge waste was <br /> subsequently delivered to the Stockton POTW , for <br /> disposal on or about September 20-21, 1989 . <br /> 5. Health and Safety Code (HSC) , Sections 25189 .5 (a) <br /> and 25203: <br /> SHAD caused the disposal of its IWTP sludge waste, <br /> identified in its Waste Analysis Plan as a hazardous <br /> waste and later confirmed by analysis as hazardous, <br /> at the city of Stockton POTW, an unpermitted disposal <br /> facility, on or about September 20-21, 1989 . <br /> 6. Title 40, Code of Federal Regulations (CFR) , Section <br /> 268.7 (a) (1) : <br /> SHAD failed to notify treatment facilities of- the <br /> appropriate treatment standards with shipments of <br /> land disposal restricted (LDR) wastes. <br /> The LDR notification which accompaniedshipmentsof <br /> hazardous wastes to treatment facilities did not <br /> contain treatment _ standard _ notifications about the. <br /> following LDR wastes: <br />
