I Ith and 1881 Rustan Road, Tracy, California <br /> Dear Mr. Infurna: <br /> I am writing in response to the invoice and letter dated November 23, 1999, we received from San <br /> Joaquin County concerning permit fees for geotechnical exploration drilling on the <br /> Pombo/Chevron/Ridgeway property during 1999. <br /> We understand the county's position concerning the permit fees and applications. We believed, based on <br /> the language in the permits for geotechnical drilling, that the permits were valid for the calendar year for <br /> which they were issued. We understand that the County's interpretation is different, and that the County <br /> requires separate permits for separate explorations. Failure of internal communication at our company <br /> lead us to rely erroneously on Chevron's direction not to apply for a separate permit for the drilling in the <br /> pipeline easement that occurred in July. We regret this error and have taken steps to make sure that the <br /> lines of communication and authority on projects are clear. We understand that the fees stated in the <br /> above-referenced invoice will resolve all of the County's concerns regarding all of the exploration efforts <br /> on the above-referenced property. Based on this understanding, we will pay the fees. A check in the <br /> amount of$712.00 and completed permit applications are enclosed. #Z Ro15 <br /> We regret that lack of communication internally on our part allowed Chevron to manipulate the situation <br /> to the detriment of the County and other parties.
