The following is an itemized list of hazardous waste violations that have not been addressed for SUVIK FARMS LLC FRENCH CAMP SHOP as of February24, 2020. Open violations from October 17, 2019 inspection Violation#301 -Facility not maintained to minimize the release of a hazardous waste. OBSERVATION Stained soil was observed near the waste oil tank and by the diesel tanks. Leaking of what appeare to be used oil was observed from a 55 gallon drum storing used oil filters. The leaking drum was punctured at the bottom and dark staining was observed on the soil. The stained soil near the diesel tanks was said to have been a diesel overfill while refueling machinery. REGULATION GUIDANCE: A hazardous waste generator must maintain and operate its facility to minimize the possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous waste constituents to air, soil, or surface water which could threaten human health or the environment CORRECTIVE ACTION: Immediately address leaks and remove and properly dispose of stained soil. Manage the waste according to Title 22 California Code of Regulations for hazardous waste. Submit a statement and supporting documentation to the San Joaquin County Environmental Health Department describing the storage and final disposition of the cleaned up waste. OBSERVATION: Hazardous waste was found stored on-site in containers that are not in good condition. Used oil filters were stored in a punctured 55 gallon steel drum. The drum was punctured at the bottom and what appeared to be used oil escaped the container. It was stated that his container was left behind by the previous owner. REGULATION GUIDANCE: Hazardous waste shall be stored in containers that are in good condition. If a container holding hazardous waste is not in good condition (e.g., severe rusting, apparent structural defects), or if it begins to leak, the owner or operator shall transfer the hazardous waste from this container to a container that is in good condition, or manage the waste in some other way that complies with the hazardous waste requirements. CORRECTIVE ACTION: Immediately transfer all hazardous wastes into containers that are in good condition.
