At that time, in addition to other
requirements, it was discussed that a new drinking water well was to be installed at the above referenced
site and that the existing drinking water well (G-1) was to be destroyed. The requirement for installation
of a new well and destruction of G-1 was based on the fact that total petroleum hydrocarbons as diesel
(TPH-d) had been detected in water samples from the G-1 well system in June 1999, October 1999, and
March 2001.
The principal contaminant of concern from an unauthorized release of petroleum from the former
underground storage tanks operated at this site is TPH-d. In an EHD letter dated September 24, 2002,
you were informed that well head treatment instead of destruction of G-1 was not acceptable.
On November 13, 2002, EHD staff again met with you. At the meeting, you indicated that you wanted to
comply with EHD directives and recommendations in order to get your site to closure. In an EHD letter
dated November 26, 2002, the November 13, 2002, meeting topics were discussed and
recommendations (including the videoing and replacement of G-1) were made. Although, some
investigation of the site was conducted in 2003 and 2004, G-1 has not been destroyed as was directed in
EHD letters dated April 10, 2003,June 17, 2004, September 30, 2004 and February 23, 2005.
Therefore, EHD will refer this case to the San Joaquin County District Attorney's office for formal
enforcement action. Questions or comments may be directed to Nuel Henderson by mail (address on
letter head), or by telephone at(209)468-3436.
Donna Heran, REHS, Director
Environmental
Health Division
Nuel C.
