Gabriel Gonzalez [EH] <br /> From: Gabriel Gonzalez [EH] <br /> Sent: Monday, April 27,2015 10:48 AM <br /> To: 'Stephen Muir' <br /> Cc: 'beckylmuir@sbcglobal.net' <br /> Subject: RE: 3931 Newton Rd., Stockton - Public Notice <br /> Hi Stephen and Becky, <br /> Thank you for your time in discussing the public notice.To summarize our conversation, my understanding is that the <br /> notices were mailed out this past weekend, but the date on the notice shows a comment period beginning on April 3. <br /> Also,you have a more complete mailing list with both the parcels' addresses and owner's mailing addresses.The mailing <br /> addresses were not reflected in the list emailed to me on Friday,April 24,2015.That list reflects a 3-mile radius from the <br /> subject site.And,you would like to re-distribute a public notice with a more accurate 60-day comment period date <br /> range and provide a distribution list that is more in alignment with the requirements of the Low-Threat Underground <br /> Storage Tank Case Closure Policy(LTCP). <br /> The following are the issues I saw in the distribution: <br /> • The San Joaquin County Community Development Department(SJCCDD)was not listed as an agency to be <br /> notified. SJCCDD is the agency that issues building permits in areas of unincorporated San Joaquin County, <br /> which is where the subject site is located. Please include SJCCDD in your new distribution list. <br /> • Because Stockton Community Development Department issues building permits for properties considered to be <br /> incorporated Stockton, it is not necessary to notify this agency. <br /> • San Joaquin County Public Works Utilities Maintenance (the last agency on the distribution list) should have a <br /> mailing address of: 1810 E Hazelton Ave.,Stockton,CA 95205. Please correct this on the new distribution list. <br /> • The second agency on the distribution list,with the address 2500 Navy Dr.,should be titled as the City of <br /> Stockton Municipal Utilities Department. Please correct this on the new distribution list. <br /> • EBMUD- East Bay Municipal Utilities District does not need to be notified. Please exclude this agency from the <br /> new distribution list. <br /> • A parcel (APN 13207010)adjacent to the subject site was not included on the distribution list. Please include <br /> owners and occupants of this parcel in your new distribution list. <br /> LTCP Notification Requirements: <br /> "Municipal and county water districts,water replenishment districts, special act districts with groundwater management <br /> authority, agencies with authority to issue building permits for land affected by the petroleum release,owners and <br /> occupants of the property impacted by the petroleum release,and the owners and occupants of all parcels adjacent to <br /> the impacted property shall be notified of the proposed case closure and provided a 60 day period to comment.The <br /> regulatory agency shall consider any comments received when determining if the case should be closed or if site specific <br /> conditions warrant otherwise." <br /> At your earliest convenience, please email me the updated notice and the new distribution list prior to distribution of <br /> the notice. <br /> Thank you, <br /> Gabriel Gonzalez, REHS <br /> San Joaquin County <br /> Environmental Health Department <br /> 1 <br />
